SMS Marketing & TCPA (Telephone Consumer Protection Act)

When opted-in, you will receive text messages (SMS/MMS) to your mobile number. These kinds of messages may include order updates, notifications, offers, coupons, or other information.
You can opt-out of this service at any time. Just text “STOP” to the phone number. After you text “STOP” to us, we will send you an SMS reply to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text “START,” and we will start sending SMS messages to you again.

Rights

In the request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to help us verify your identity and process your request. Such information may include your First Name, Last Name, Street Address, City, Zip Code, and Date of Birth. This information will be used only for the purposes of verifying your identity and processing your request. We may not be able to comply with your request if we are unable to confirm your identity or to connect the information you submit in your request with personal information in our possession.

You may only make a request for access or deletion twice within a twelve-month period.

If personal information about you has been processed by us as a service provider on behalf of a Marketplace (Amazon, Walmart, etc.) and you wish to exercise any rights you have with such personal information, please inquire with the Marketplace owner directly. If you wish to make your request directly to us, please provide the name of the Marketplace on whose behalf we processed your personal information. We will refer your request to that Marketplace, and will support them to the extent required by applicable law in responding to your request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days from the date of receiving your request), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding the date of the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to access or deletion requests unless they are excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Sales Opt-Out Rights

California residents aged 16 and over have the right to direct us to not sell your personal information. As stated above, EHD. does not ‘sell’ customer personal information.

Authorized Agent

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent's permission to do so and will verify your identity directly with you.

Non-Discrimination

EHD will not discriminate against you for exercising any of your rights.

Shine the Light

Under California’s “Shine the Light” law, EHD customers who are California residents can request information about the types of Personal Information (if any) shared by EHD with third parties (if any) for “Direct Marketing Purposes” within the preceding calendar year, as well as the names and addresses of those third parties. “Direct Marketing Purposes” means the use of certain types of Personal Information to solicit or induce a purchase, rental, lease, or exchange of products, goods, property, or services directly to you.

If you are a California resident, you may email your request to orders@expresshomedirect.com. Please (i) put “California Privacy Information Request” in the subject line and in the body of your message and (ii) state that you are a California resident and provide your California address. You may make one (1) request per calendar year.

Additional Information for Nevada Residents

Nevada law requires businesses that sell the personally identifiable information of Nevada residents to provide a mechanism to opt-out of such sales. We can confirm that these rules do not apply to us as we do not sell personal data for commercial gain (as stated above). Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that EHD is not responsible for third party access to your account that results from theft or misappropriation of your account. EHD and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Children Under Thirteen
EHD does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.expresshomedirect.com only with permission of a parent or guardian.

Cancellation/Refund Policy

You can cancel your order before it ships at any time with no cost to you. Unfortunately, once an order has been dispatched to the carrier for delivery, we are not able to stop your order from being delivered. Certain exceptions apply on products advertised as "Final Sale", "Clearance" and/or "Special Buy" and cannot be returned. For individual cancellation & refund policies please see below:

Mattresses, Adjustable Bases & Box Spring Refund Policy

Mattresses, adjustable bases & box springs ordered on www.expresshomedirect.com are by our 120-Night Comfort Guarantee, there are no refunds on these purchases. Customers that purchased a mattress and decide within 120 days from delivery, that they no longer are satisfied with their mattress are eligible for an exchange only. There are no refunds during an exchange.

Some restrictions may apply. Eligibility Requirements & Guidelines:

Contact us within 120 days of receiving your order.
A one time state disposal & recycling fee may be applicable, depending on the state.
We will arrange a convenient date & time for a pick up of your mattress.
Please note If we removed your old mattress at the time of your initial delivery, it will be disposed of and cannot be returned to you.
Not eligible on defects. Defects are covered under the manufacturer warranty only.
120 Night Comfort Guarantee for an exchange only and is not eligible to be returned. There are no returns on mattresses due to health code reasons. Read more about the 120-Night Comfort Guarantee.
You must select a new mattress for the exchange at price greater than or equal to original purchase price.
A pick up and re-delivery fee of $275.00 will be added to your exchange.
Past the 120 days there are no returns & refunds on mattresses, adjustable bases & box springs.

Mattresses must be free & clear or any stains, rips or tears, not only will this void your mattresses manufacturer warranty but will also void the 30-Day Money Back Guarantee and the 120-Night Comfort Guarantee . We always recommend purchasing a Mattress Protector with your new mattress order to stay protected.

Bedding Refund Policy (comforters, sheets, duvets, pillows, toppers, protectors etc.)

Bedding & non-mattress products ordered on www.expresshomedirect.com are covered by the 30-Day Money Back Guarantee. Customer's who purchase bedding & non-mattress products and decide within 30 days from receiving their order, that they no longer are satisfied with their bedding & non-mattress products purchase are eligible for a complete refund of the purchase price, less any return shipping fees and processing fees.

We value your business and your satisfaction is what matters most. If you are not satisfied with your purchase, you may return it to us following these guidelines:

All returns do require a Return Authorization number. Please contact us at orders@expresshomedirect.com or by phone at 1-833-246-8732 for a Return Authorization. This number must be clearly displayed on the outside of the return package.
Shipping charges, either way, may not be eligible for a complete refund. We will try our best to waive any return shipping fees
Returns must be requested within 30 days of the original ship date.
Products must be returned in original packaging and in original condition.
Returns maybe subject to a restocking charge of up to 25%.
Unauthorized returns will be refused.
Refunds will be issued for merchandise only upon receipt and inspection of returned merchandise, less applicable restocking charges and shipping fees.
If original form of payment is no longer available, a 100% refund in the form of a store credit will be issued instead.
There are no returns after 30-days.
Absolutely no returns or refunds on bedding products that are dirty, soiled or stained. No exceptions.

Damaged Merchandise & Defects

For products with Manufacturing defects, please contact us at 1-833-246-8732 or by email at orders@expresshomedirect.com and we will assist you with a replacement or a refund. If your order arrives damaged due to shipping, keep the original shipping cartons and all packing materials for inspection by the carrier. Please contact us at orders@expresshomedirect.com to review your options. We will try our best to accommodate any special requests.

Furniture Refund Policy

Upon delivery, please carefully examine each piece of your furniture. If you wish to return the furniture for preference reasons, you must contact Express Home Direct Customer Service within 3 days of your delivery. You may e-mail us orders@expresshomedirect.com or call us at 1-833-246-8732.

To qualify for a refund, the following criteria must be met:

A return request must be made within 72 hours of receiving your item(s) by calling us at 1-833-246-8732.
Items must be in new condition and in the original packaging to qualify for a refund.
Assembled or modified items are unable to be returned or refunded.
The delivery fee will not be refunded.
Original form of payment will be refunded less a 25% restocking fee & any applicable return shipping fees.
If original form of payment is no longer available, a 100% refund in the form of a store credit will be issued instead.

In the rare occurrence that an item arrives damaged on delivery or is otherwise damaged before your possession, please notify the delivery team or a customer care representative immediately. For furniture, arrangements will be made for a qualified repair technician to come to your home and correct the damage if possible. For home decor, arrangements will be made to exchange the item. Please note that we reserve the right to repair or replace your furniture as deemed necessary at our sole discretion.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. EHD content is not for resale. International Users
The Service is controlled, operated and administered by EHD from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the EHD Content accessed through www.expresshomedirect.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification
You agree to indemnify, defend and hold harmless EHD, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. EHD reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with EHD in asserting any available defenses.

Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and EHD agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. EXPRESS HOME DIRECT AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXPRESS HOME DIRECT AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF EXPRESS HOME DIRECT OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Governing Law

EHD reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New York and you hereby consent to the exclusive jurisdiction and venue of courts in New York in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and EHD as a result of this agreement or use of the Site. EHD's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of EHD's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by EHD with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and EHD with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and EHD with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

No Relationship Clause

You agree that no joint venture, partnership, employment, or agency relationship exists between you and EHD as a result of this agreement or use of the Site. EHD's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of EHD's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by EHD with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and EHD with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and EHD with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms
EHD reserves the right, in its sole discretion, to change the Terms under which www.expresshomedirect.com is offered. The most current version of the Terms will supersede all previous versions. EHD encourages you to periodically review the Terms to stay informed of our updates.

Strike-Through Pricing and Savings
The List Price is the suggested retail price of a product as provided by a manufacturer, supplier, or seller. EHD will only display a List Price if the product was offered by other retailers at or above the List Price in the past 90 days. List prices may not necessarily reflect the prevailing market price of a product. List Prices, Sale Prices & Prices are updated multiple times per month. We exclude prices paid by customers for the product during a limited time deal.

Up To 60% Off
Sale prices vary each week, and certain products are discounted up to 60% during these time periods. Products are priced up to 60% off based on a combination of previous sale prices, list prices and MSRP (manufacturers suggested retail prices). Free Shipping Contiguous 48 States
Free standard ground shipping within the contiguous United States, to the lower 48 states. Free shipping is excluded from Alaska & Hawaii. Puerto Rico is not identified as a state, and is also excluded from free ground shipping. Additional shipping fees maybe applicable to customers wishing to ship their orders to Alaska, Hawaii or Puerto Rico. We will contact you regarding your order prior to processing payment to confirm these additional fees.
